HOW DOES THE PROGRAM WORK?
HOW IS THE $2500 PAID?
If Refine Mortgage Inc does miss the closing and has to pay the $2500, this is to be made via check after closing and funding of the loan.
WHAT PROGRAMS & PROPERTY TYPES?
- This is for FHA, VA, CONV Conforming & High Balance Loans Only
- The loan may only be a purchase transaction using financing with Refine Mortgage
- The loan amount must be at or below the conforming or high balance loan limit for the subject property county.
- This program is not eligible on USDA, Jumbo, Non-QM or loans with Down Payment Assistance.
3rd Party Delays
Refine Mortgage Inc is not liable for delays (“Delays”) caused by events beyond the control of Refine Mortgage Inc which prevent Refine Mortgage Inc from meeting any of its obligations under this Guarantee, including but not limited to, delays caused by the consumer or third parties. Accordingly, this Guarantee is not enforceable if such delays occur and the loan closes after the Guarantee time period. If no delays occur and all the foregoing conditions are satisfied and the loan doesn’t close within 15 days of the Guarantee Trigger Date (as applicable), then Refine Mortgage Inc will give the borrower a check of $2500.00
WHAT DO I HAVE TO DO?
- The borrower must express intent to proceed within 1 business day from the Loan Estimate receipt date and it must be documented in the system.
- Borrower must submit all required credit documents within 1 business day from the Loan Estimate (LE) receipt date and express an intent to proceed.
- This may require the borrower to request a rush on their appraisal delivery date and agree to pay a rush fee in order to meet the on-time closing date.
- The borrower must sign the guarantee form prior to execution of contract
WHEN DOES THE 15 DAYS START?
The “Guarantee Trigger Date” is defined as the date as the fully executed is received by Refine Mortgage Inc. A “fully-executed” contract is defined as being agreed to and signed by both buyer and seller.
OTHER TIMELINES
- The 15 days include all days except for federal holidays
- The Preliminary Title Report must be received within 2 business days from the “Guaranteed Trigger Date”.
- The appraisal must be received within 6 business days of the Loan Estimate (LE) sent date and value is at or above the purchase price.
